The Mike Duffy
courtroom saga is now over. With many modern day justice systems adhering to the principle advocated by the English
jurist William Blackstone that it is "better that ten guilty persons escape
than that one innocent suffer", Duffy's acquittal is not
entirely surprising. The judge's ruling merely suggests the Crown was unable to
convince him of the required mens rea. As
Duffy's acquittal does not necessarily infer complete innocence and with many
people believing Duffy's conduct was at best less than acceptable, the Senate will
now need to examine the best way forward.
